1. Preamble and Scope
This Policy is an integral part of the Mcubes Online Terms of Use, governing all financial transactions, refunds, cancellations, and explicitly defining the financial accountability of Tutors (independent contractors) distributing content on the Platform. The Tutor agrees to be bound by these financial protocols as a condition of their partnership with Hellobugs Entertainment (“the Company”).
2. Strict Cancellation Policy for All Services
2.1. Order Finality: Strictly No Cancellation is accepted once an order (for either a standard course or a Tutor’s service/session) is successfully placed and paid for. The immediate granting of the digital license constitutes full service delivery, making the transaction non-cancellable.
2.2. User Due Diligence: Users must review all course and session details carefully before purchase, as no allowances are made for errors or change of mind.
3. Refund Policy: Tutor Financial Accountability
3.1. General Rule: All purchases are non-refundable except under the specific condition of a Material Discrepancy (Not As Described).
3.2. Limited Refund Exception (Tutor Liability): A refund will only be considered if the purchased course or session is materially and demonstrably different from its official description, and this failure is directly attributable to the Tutor (e.g., promised live sessions were not delivered or offered).
3.3. Financial Consequences for Tutors: If a refund is approved under the “Not As Described” exception:
- Tutor Chargeback: The refund amount paid back to the User will be charged back directly to the responsible Tutor’s outstanding account balance with Hellobugs Entertainment. The Tutor acknowledges and accepts full financial responsibility for failure to meet the advertised contractual deliverables.
- Platform Fee Retention: The Company will still retain its administrative, platform, and payment processing fees (such as the 4.5% PayPal fee and internal platform fees) from the original transaction before the remainder is charged back to the Tutor.
3.4. Mandatory Reporting Protocol: Users must submit a formal, evidence-backed report to howdy@darkgrey-echidna-669001.hostingersite.com within 7 days of the purchase or the scheduled session completion for investigation.
4. Tutor Payout and Financial Terms
4.1. Minimum Payout Threshold: Tutor earnings will only be disbursed once the accrued balance reaches a minimum threshold of 50 USD (Fifty US Dollars). Balances below this amount will roll over to the next payout cycle.
4.2. Payout Method: All earnings are paid directly to the Tutor’s designated bank account or PayPal account.
4.3. Transaction Fee Guarantee: Hellobugs Entertainment ensures that Tutors receive their full share of earnings above the threshold. The Company assumes responsibility for all bank transaction fees and payment charges associated with the disbursement of the earnings from Mcubes Online to the Tutor’s bank account. No payment charges will be deducted from the Tutor’s share for this transaction.
4.4. Payout Schedule: Payouts are typically processed on a monthly cycle, following the deduction of refunds (chargebacks) and any applicable platform commission fees.
5. Anti-Fraud, Misuse, and Penalty Policy (Applicable to All)
5.1. Prohibited Actions: Account sharing, fraudulent transactions, and chargeback abuse are strictly forbidden. No misuse is entertainment.
5.2. Consequences and Penalty: Any user caught engaging in prohibited actions faces immediate account cancellation, permanent ban, forfeiture of all payments (No refund), and a financial penalty levied to cover damages. This penalty will be the greater of $5.00 USD or 15% of the disputed transaction value. We may hold the existing payment up to 180 days before releasing it to avoid future disputes from the customers. Once the threshold is over, the pending amount will be refunded after the deduction.
6. Intellectual Property Acknowledgment
All course content is the copyrighted intellectual property of the creators. The actions of account sharing and unauthorized distribution are a direct breach of copyright law and will lead to severe sanctions as outlined in Section 5.
